O recurso foi <strong>favor\u00e1vel a uma a\u00e7\u00e3o<\/strong> impetrada pelo\u00a0<a href=\"http:\/\/www.sifep.org.br\/\" target=\"_blank\" rel=\"noopener noreferrer\">Sifep \u2013 Sindicato dos Farmac\u00eauticos do Estado da Para\u00edba<\/a>.<\/p>\n<p>O caso analisado diz respeito a uma <strong>rede de supermercados<\/strong> que contratou 68 farmac\u00eauticos entre 2010 e 2014, cujas contribui\u00e7\u00f5es foram recolhidas em favor do <strong>Sindicato dos Empregados no Com\u00e9rcio<\/strong> local. O Sifep cobrou o repasse, mas o Tribunal Regional do Trabalho da 13\u00aa Regi\u00e3o <strong>rejeitou o pedido<\/strong>.<\/p>\n<p>Ap\u00f3s essa liminar, o sindicato<strong> recorreu ao TST<\/strong>, sob a alega\u00e7\u00e3o de que a exist\u00eancia de categoria profissional diferenciada <strong>anula o enquadramento<\/strong> sindical pela atividade predominante do empregador. Na avalia\u00e7\u00e3o da ministra Dela\u00edde Miranda Arantes, relatora do recurso, \u201cesse entendimento prevalece <strong>independentemente<\/strong> de a empresa estar representada em norma
